Frankford,DE : Frankford man faces third DUI on October, Saturday 28th 2017

A Frankford man was charged with his third DUI after police say he crashed his vehicle into a utility pole Oct. 28 and fled the scene.

Rolando O. Gutierez, 53, also known as Carlos C. Sandoval, was driving a 2006 Kia Sedona at 4:54 p.m. southbound on Pepper Road just south of Lazy Lagoon Road when he lost control while navigating a moderate left curve, said Master Cpl. Gary Fournier of the Delaware State Police.

Gutierez drove off the west side of the roadway and struck a utility pole. After the crash, Fournier said, Gutierez removed his 7-year-old son from the vehicle and began walking along Pepper Road when a passing motorist picked them up and drove them home.

Gutierez was contacted by troopers at his residence and taken into custody after a DUI investigation, Fournier said. Emergency medical personnel were also called to the residence to check on his 7-year-old son, who was not to be properly restrained in the van, Fournier said. The boy was transported to Atlantic General Hospital in Berlin, Md., where he was treated for nonlife-threatening injuries.

Gutierez was charged with third offense driving under the influence of alcohol (two previous convictions; 04/11/02 and 07/06/03), second-degree vehicular assault, endangering the welfare of a child, failure to report a collision resulting in injury, and various other traffic related offenses. He was committed to Sussex Correctional Institution on $5,503 secured bond.
