CHARLOTTE, NC : A driver has been charged with DWI in a deadly northeast Charlotte crash on Friday, July 21, 2017

A driver has been charged with DWI in a deadly northeast Charlotte crash that happened early Friday morning.

The crash happened around 1:48 a.m. on N. Tryon Street at Austin Drive. Charlotte-Mecklenburg police say 23-year-old Benjamin James was driving a 2013 Dodge Challenger at a high rate of speed when he lost control and drove off the side of the road, striking a fence and a tree.

"After impact with the tree, the vehicle rotated into a telephone pole coming to rest on its roof on Austin Drive," police say.

Police arrived to find the Dodge on its roof. Medic pronounced the front passenger dead on scene. Graves went to Carolinas Medical Center with serious injuries.

Graves was charged at the hospital with Driving While Impaired.

The passenger's name will be released after the next of kin has been notified of his death.

Several lanes surrounding the crash scene were closed for a time.
